* Register as a Public Works Contractor
* Make sure your listed subcontractors (and tier subcontractors) are registered as a Public Works Contractor
* Pay prevailing wages (for the type of work being performed on the Public Works Project) (Labor Code 1771-1774)
* Follow apprenticeship requirements (Labor Code 1777.5)
* Maintain and submit Certified Payroll Reports (Labor Code 1776)
** Prime Contractors are 100% responsible for ensuring all listed subcontractors & tier subcontractors are complying with all prevailing wage laws and requirements.
* Register public works projects with the DIR within 30 days of awarding the contract (however, no later than the first day workers commence working on the said project)
* Notify contractors that they (and their subcontractors/tier subcontractors) must register with the DIR
* Ensure that all public works contractors pay prevailing wages and are in compliance with all public works laws and requirements
* Report suspected public works violations to the DLSE
* Require contractors to post jobsite notices on public works projects
* Worker misclassification
* Under-reporting of hours
* Failure to report all workers
* Demands that worker pay wage kickbacks (Copeland "Anti-kickback" Act)
* Failure to fund fringe benefits
Violations may result in the following but not limited to:
* Restitution of wages owed, plus interest and liquidated damages
* Monetary penalties
* Debarment of up to 3 years
* Criminal Prosecution
* Reimbursement of investigation costs to the DIR
